Introduction
The agreement is made between hotproperties4u “we”/”us”/”ours” and the customer/advertiser/vendor “you”/”your”. The “service” is the online property advertising purchased by the customer and provided by the web site hotproperties4u. By submitting your details you are entering into the agreement and accepting that you have read and agree to our terms and conditions.

By advertising your property details with us you agree to us publishing your advertisement details on the World Wide Web via our web site, web links, affiliates and advertising as we see fit.

Copyright
All material, content and the web site itself are copyright of hotproperties4u and must not be copied or reproduced in any way. You may produce copies of your own advertisement for your own non commercial use.

Property rights
By submitting your property details to hotproperties4u for advertising you agree that you have the legal sole right to sell/let the property.

The description that you supply is true and accurate and not a misleading representation of the property. We must stress that hotproperties4u do not take any responsibility for the accuracy of the information supplied and can not be held liable. The accuracy is solely the responsibility of the customer.

Fee
You agree to pay the fee in full before your property is advertised, on receipt by us of your payment you agree to hotproperties4u publishing your advertisement as soon as possible. We are obligated to restrict our financial responsibility and exposure. The fee/price we charge, if any, relates to the set up cost of each property advertised on our web site and the cost of the initial administration involved. Once a customers property details have been live on hotproperties4u for a period exceeding 7 days our service is deemed as completed. After this 7 day period has passed, further advertising and support is provided free of charge. Arrangements to advertise properties on our web links and affiliate sites may be subject to change, or cancellation without prior notice. Therefore we can not guarantee unlimited publication on partner sites, whether paid or not, although we do endeavour to offer unrestricted access. The maximum liability for any loss regardless of reason, fault or negligence, will be limited to the amount equal and not exceeding the value of the advertising fee received. We reserve the right to alter/edit or change the price/options/packages at any time without notice.

Commission/Hidden charges
The prices on our web site are the true costs; there are no hidden costs or commission taken.

Selling price and viewings
You will set your own selling price and also arrange and conduct the viewing of your advertised property. We cannot be held responsible, or liable, for any accident or claim whilst viewings are taking place, or at any other time.

Photographs and virtual tours
You will provide the photographs of your property, you must have the rights to the photographs that are submitted and by supplying them to us you are agreeing to grant a copyright license to hotproperties4u.  If you have selected a virtual tour the photographers will contact you within a few days of activating you advertisement.  A specific date and time will be arranged for the photography, you must ensure that you are at the property for this as you will still be charged for this service if you are not there.  For extreme and international locations there will be additional travel costs. 

Service
We will to the best of our efforts ensure that the facilities of hotproperties4u are available at all times however, we reserve the right to take the web site off line without prior notice, although this will be kept to a minimum, for example for maintenance. Any maintenance or improvements which require the web site to be off line will be kept to a minimum. We cannot guarantee the percentage of availability and accept no financial liability for any suspension in service at/for any time.

For Sale boards
Our ‘For Sale’ boards are made from quality materials, are professionally designed and produced to aid the response to your advertisement, if chosen. These boards are included in the price of certain packages, please see sellers section. No refunds or returns can be given unless the board is proven to be faulty by us; under this circumstance a replacement will be actioned.

Keep us informed
We would like you to keep us informed of any changes in circumstances. In particular when you would like to stop receiving communications from potential buyers/tenants, this ensures you are not disturbed and our web site is current and up to date.

Security and confidentiality
Your declared details are stored on a secure database and only the details you wish to be shown will be advertised. No confidential information is passed or sold to other organisations or companies; we believe your personal details to be private. Our web site is hosted in a secure protected environment with excellent fire, security, and back up measures in position and a high level of assistance is anticipated.

Private advertising
Our web site is for the sole use of advertising your property for sale/rent; you are not permitted to advertise any other service, any form of commercial advertising or any agent contact details. No links to other web site/domains are permitted unless with our written permission.

Multiple properties
If you wish to add more than one property please ‘contact us’ as attractive concessions may be available, remember no commission, no hidden extras.

Transferable
Property listings are not transferable and must not be used to advertise more than one property unless you have our written permission.

Property descriptions
We reserve the right to edit/amend/alter or delete any descriptions we believe or know to be untrue or misleading to improve presentation of your advertisement and to comply with the provisions of the Property Misdescriptions Act 1991. Your property description/advertisement must only provide a factual breakdown of the property features. It must not include false or misleading claims of property features; it must only be a factual account of features which can be verified by reasonable inspection or confirmed/verified by documentation. Your submitted details must be a fair, honest and accurate description. We must emphasize that the information supplied by you is your responsibility and you agree to indemnify hotproperties4u from any claims or expenses. Any potential purchaser must satisfy themselves by the necessary means that the advertised details are correct and accurate, we do not visit properties so cannot verify any of the details submitted for publication by the vendor.

Affiliate sites
The publication on affiliate sites will commence as soon as possible and we cannot be held responsible for any interruption, suspension, delays or accuracy of their listings as they are beyond our control. We cannot guarantee how listings will be searched, displayed or operated due to the design of these web sites. We only forward the information to these sites. If there are any errors we will liaise with the site in question to resolve the issue as soon as possible but we cannot accept any liability, financial or legal for their advertisement/display/delay if different to expected.

We can not accept any responsibility, financial or legal for the linked sites, they are merely there as suggested sites for products/services when a property transaction is taking place. It is your responsibility to choose whether to use their services or other companies.

Refund Policy
There will be no refund of the advertising fee, even if the purchaser/offer was not introduced/sourced by us, an offer is made, for loss of service temporarily or permanently under any circumstances. A discretionary refund may be offered after being reviewed by us, however, under no circumstances will our liability exceed the advertised fee received. Clause 8(3) of The Consumer Protection (Distance Selling) Regulations 2000 states that the statutory cancellation (cooling off) period of 7 days for services purchased over the internet, does not apply where performance of that service has already commenced with the customer’s agreement. Our online payment facilities are designed to activate your public advertising automatically and therefore, by making a payment for advertising on this site you signify your agreement to the advertising service commencing IMMEDIATELY and that the standard cooling-off period does not apply as per Cause 8 (3) of the Regulations.

Recommendation
If you are with an estate agent or have signed a selling contract we recommend that you check this contract and inform that party, prior to advertising with us. Hotproperties4u hold no responsibility with regards to agreements with existing parties. If you are with another party you must not use their photographs without their permission. It is the customer’s responsibility to ensure they have the copyright over the information provided to us, and you agree to indemnify hotproperties4u against any claim or expense in respect of copyright law.

It is your responsibility to verify any information that is expressed/contained in this web site before acting upon it.
We reserve the right to edit/alter/change any term or condition without prior notice, any changes will be posted as soon as possible to our web site.
